5. Intellectual Property Rights
All Content on the Website is the property of Seema Kohli or her licensors and is protected by copyright, trademark, and other intellectual property laws. As stated on the Website, all artworks and content are protected by copyright. The name “Seema Kohli”, the Website’s logos, and related marks are the intellectual property of Seema Kohli.
Nothing on the Website grants you any licence or right to use any Content, including any artwork or image, without our prior written permission (or that of the relevant rights holder). You may not reproduce, download, republish, sell, distribute, or commercially exploit any Content. Any unauthorised use terminates the permission granted by us and may violate applicable law.
Requests to reproduce or license any artwork or Content (for example, for press, academic, or commercial use) should be directed to us at [insert contact email].

6. Artworks and Affiliated Galleries
The Website displays Seema Kohli’s artworks, exhibitions, and projects for information and viewing purposes only. Artworks shown on the Website are not offered for sale directly through the Website.
If you wish to enquire about acquiring an artwork, you will be directed to connect with the relevant Affiliated Gallery. Any sale, purchase, pricing, availability, authentication, delivery, or other arrangement relating to an artwork is a matter between you and the Affiliated Gallery, on that gallery’s own terms. Seema Kohli is not a party to, and accepts no liability in respect of, any transaction conducted with an Affiliated Gallery, except to the extent expressly agreed in writing.
Images of artworks are for illustrative purposes. Colours, dimensions, finishes, and other details may vary from what appears on your screen due to display settings, photography, and the handmade nature of the works.

7. Products, Store, and Pricing
The Website offers books, publications and other items for sale. We try to describe and display Products as accurately as possible; however, we do not warrant that Product descriptions, images, editions (such as “normal” or “limited” editions), or other Content are complete, current, or error-free.
All prices are listed in Indian Rupees (₹) and are exclusive of applicable taxes, which are indicated at checkout. Prices, offers, and the availability of Products are subject to change without notice. Limited edition Products are available in limited quantities and are subject to availability.
In the event of an obvious pricing or description error, we reserve the right to cancel or decline any order placed for a Product listed at an incorrect price, even after an order confirmation has been issued, and to refund any amount paid.

8. Orders, Coupons, and Acceptance
When you place an order through the Website, you make an offer to purchase the selected Product(s) subject to these Terms. We may accept or decline your order at our discretion. A contract is formed only when we confirm acceptance of your order or dispatch the Product, whichever is earlier. An automated acknowledgement of receipt of your order does not, by itself, constitute acceptance.
Discount codes, coupons, and promotional offers may be applied at checkout subject to their specific terms, eligibility, and validity. Coupons are non-transferable, cannot be exchanged for cash, and may be withdrawn or modified at any time. We reserve the right to cancel orders where we reasonably believe a coupon or offer has been misused.

9. Payments
Payments for Products are processed through a third-party Payment Gateway. By making a payment, you agree to provide accurate payment information and authorise the charge for the total amount, including any applicable taxes and shipping charges. Website does not collect or store your payment card or account credentials; these are handled by the Payment Gateway in accordance with applicable laws and security standards. Your use of the Payment Gateway is subject to its own terms and privacy policy.
We are not responsible for any loss arising from payment failures, declines, or delays caused by the Payment Gateway, your bank, or your card or account provider.

10. Shipping and Delivery
We will arrange delivery of Products to the address you provide. Estimated dispatch and delivery timelines, shipping charges, and serviceable locations will be applicable separately and will be intimated to you at checkout. Delivery timelines are estimates only and are not guaranteed. Risk of loss and title for Products pass to you upon delivery.
We are not liable for delays or failures in delivery caused by the courier or logistics provider, incorrect address details provided by you, or circumstances beyond our reasonable control. Any customs duties, import taxes, or similar charges on international shipments are your responsibility.

11. Cancellations, Returns, and Refunds
You may request cancellation of an order before it has been dispatched. Once dispatched, an order cannot be cancelled but may be eligible for return as set out below.
Returns or replacements are accepted only where a Product is received damaged, defective, or incorrect, and where you notify us within [insert number] days of delivery with supporting photographs and order details. Products must be returned unused and in their original condition and packaging. Return shipping charges will be borne by the customer, in the event the return is not due a direct breach by us.
Where a return or cancellation is approved, refunds will be processed to the original payment method within 10-12 business days through the Payment Gateway. Shipping charges are non-refundable, except where the Product was damaged, defective, or incorrect. Limited edition or specially ordered items may be non-returnable except where damaged or defective.

16. Disclaimers and Warranties
The Website and all Content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Website will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Website or its servers are free of viruses or other harmful components.
Nothing in these Terms excludes or limits any rights you have as a consumer under the Consumer Protection Act, 2019 or other applicable law that cannot be excluded or limited.

17. Limitation of Liability
To the maximum extent permitted by applicable law, Seema Kohli and her representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or opportunity, arising out of or in connection with your use of (or inability to use) the Website or any Products. Our total aggregate liability arising out of or in connection with any Product purchased through the Website shall not exceed the amount paid by you for that Product.
The Website is controlled and operated from India and is intended for users in India. We make no representation that the Website or Products are appropriate or available for use in other locations. You agree to indemnify, defend, and hold harmless Seema Kohli, the Website and her representatives from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the Website or Content, or your violation of any law or the rights of any third party.

19. Privacy and Cookies
Your use of the Website is also governed by our Privacy Policy and Cookie Policy, which explain how we collect, use, and protect your personal data and how we use cookies. By using the Website, you consent to such processing as described in those policies.

20. Suspension and Termination
We may, at our discretion and without notice, suspend, restrict, or terminate your access to the Website (or any part of it) if we reasonably believe you have breached these Terms or applicable law, or to protect the Website, other users, or our rights. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) shall survive.

21. Changes to These Terms
We may update or modify these Terms from time to time to reflect changes in our practices, Products, or legal requirements. The updated version will be posted on this page with a revised “Last Updated” date. Your continued use of the Website after changes are posted constitutes your acceptance of the revised Terms.
